Livingston County Child Support Attorney

At Robert C. Gardella, PLLC, I am dedicated to assisting families with all their family law needs, including child support and child custody matters. Since no two support orders are alike, it is important to have a strong advocate for your divorce or child custody case.

I understand how this can be a difficult, emotional and stressful time for you. That is why I always keep my family law clients well informed about their cases and return phone calls the same day. From my law office in Brighton, Michigan, I represent clients throughout Livingston County and the surrounding areas. For more information about spousal support or child support, contact me to schedule your free half-hour initial consultation.

Child Support

Child support calculations are based on many factors, including income of both parents, number of children, the number of parenting time overnights assigned to each parent, health insurance premium costs paid each month for the children, tax exemptions assigned to each parent, and daycare expenses. As a Livingston County, Michigan, child support attorney, I can help you with any child support issues you may have, including obtaining a child support order, enforcements and modifications.

If you already have an existing child support order, it is important to note a change to the Michigan child support formula that went into effect on October 1, 2008. I can help modify your existing child support so that it is in accordance with the new rules.

Spousal Support

I represent both women and men in determining spousal support (alimony). Factors that determine spousal support include:

  • Past relations and conduct of the parties
  • Length of marriage
  • The source of and amount of property awarded to the parties
  • Age of the parties
  • Ability of the parties to pay spousal support
  • Present situation of the parties
  • Needs of the parties
  • Health of the parties
  • Prior standard of living of the parties and whether either is responsible for the support of others
  • General principles of equity

Spousal support can be either temporary, short-term, long-term or permanent. However, permanent spousal support is generally for lengthier marriages and is not as common. Spousal support is modifiable as to monthly amount and duration if decided by the court. However, spousal support can be made nonmodifiable if both parties agree in writing. I also can assist with enforcements and modifications of spousal support orders.
